1. Welcome to KCCA
Welcome to Kristin Cafferty Creativity Academy (KCCA)!
KCCA is an online creative learning community designed to help children explore their imaginations, develop artistic skills, strengthen creative thinking, and build confidence through art.
Founded by professional artist and retired art educator Kristin Cafferty, KCCA encourages children to experiment, make independent artistic decisions, solve problems, and discover the joy of creating.
These Membership Terms & Conditions ("Terms") explain the responsibilities, expectations, and agreements associated with participating in KCCA.
By purchasing a membership, the adult account holder agrees to these Terms on behalf of themselves and their participating household members.
Please read these Terms carefully before purchasing a membership.
2. Membership Eligibility and Family Accounts
KCCA is designed primarily for children ages 6–12.
All memberships must be purchased, owned, and managed by an adult who is at least 18 years old.
KCCA operates through family memberships. Children do not create individual accounts or personal profiles.
Each membership is intended for one household and may be used by children within that household under the supervision of their parent or legal guardian.
Membership access may not be shared with individuals outside the registered household, including friends, extended family living elsewhere, other households, schools, or organizations, without written permission from KCCA.
Parents and guardians are responsible for maintaining the confidentiality of their account credentials and supervising their children's participation.
3. What Your Membership Includes
KCCA provides a growing collection of creative learning experiences designed to encourage artistic exploration, independent thinking, and skill development.
Membership features include:
Studio Projects
Two new prerecorded Studio Projects each month, featuring artistic instruction, creative challenges, and opportunities for children to make independent decisions.
Sketchbook Sparks
Four creative sketchbook prompts each month, designed to encourage imagination, experimentation, and creative thinking without pressure to produce a perfect result.
Artistic Toolbox
Skill-building lessons and demonstrations covering artistic techniques, materials, and concepts that children can revisit as needed.
Artist Connection
Introductions to artists, artistic movements, and creative ideas connected to monthly themes.
In the Studio with Kristin
Two scheduled live online sessions each month, offering opportunities to create together, ask questions, and connect through art.
Student Spotlight Gallery
Optional opportunities for families to submit and celebrate children's creative work, subject to KCCA's submission guidelines and parental permissions.
Parent Connection
Resources and communications to help adults support their children's creativity, encourage independent thinking, and foster positive creative experiences at home.
Membership content, scheduling, and features may evolve as KCCA grows. Material changes will be communicated to members in advance when reasonably possible.
4. Membership Pricing and Automatic Renewal
KCCA offers a monthly recurring membership.
The introductory Founding Member rate is $29.99 per month for eligible families who join during the designated founding enrollment period.
Membership fees are charged automatically to the payment method provided during registration.
Unless canceled, memberships automatically renew each month at the applicable subscription rate.
The amount, billing frequency, renewal terms, and cancellation method will be clearly disclosed during checkout before payment is authorized.
Applicable taxes, if any, will be disclosed before purchase.
By enrolling and providing affirmative consent to recurring billing, the adult account holder authorizes KCCA and its payment processor to charge the applicable membership fee at each renewal until the membership is canceled.
KCCA will provide renewal reminders and other subscription notices as required by applicable law.
5. Founding Member Pricing
Families who enroll during the designated founding membership period receive the introductory rate of $29.99 per month.
This rate remains available for as long as the founding member maintains an uninterrupted, active, paid membership.
If a founding member cancels their membership, allows it to expire, or otherwise loses continuous membership status, the founding member rate is not guaranteed to be available upon rejoining.
A returning member may be required to enroll at the membership price offered at that time.
Founding member pricing applies only to the eligible membership and is not transferable to another household or account.
KCCA will honor the stated founding member rate during continuous qualifying membership, except where a change is required by applicable law or expressly agreed to by the member.
6. Membership Cancellation
Members may cancel their membership at any time.
Cancellation stops future automatic renewals and recurring membership charges.
Members may cancel using the online cancellation method provided through their account or by contacting KCCA through the designated cancellation email address.
Cancellation requests will be processed in accordance with applicable law, without unreasonable barriers or delays.
When a membership is canceled:
- No further recurring membership charges will be made after the effective cancellation, unless otherwise legally owed or separately authorized.
- Membership access will continue until the end of the current paid billing period.
- Access to members-only lessons, videos, live sessions, and resources will end when that paid period expires.
- The former founding member rate will not be guaranteed if the family later rejoins.
Members should cancel before their next scheduled renewal to avoid another recurring charge.
KCCA will provide confirmation of cancellation.
7. Refund Policy
KCCA provides access to digital educational content and membership resources.
Membership fees are nonrefundable once the applicable billing period has begun, except where a refund is required by law.
KCCA does not ordinarily provide refunds or prorated credits for:
- Unused membership time
- Missed live sessions
- Lessons or resources not viewed
- Changes in personal schedules or circumstances
- A child's decision not to participate
Canceling a membership prevents future renewals but does not ordinarily result in a refund for the current paid billing period.
Refund requests involving duplicate charges, billing errors, or other legally protected circumstances will be reviewed individually.
Nothing in this policy limits any refund or consumer rights that cannot legally be waived.
8. Art Supplies and Additional Expenses
Membership fees provide access to KCCA's digital learning experiences and do not include physical art supplies unless expressly stated otherwise.
Families are responsible for obtaining any materials they choose to use.
KCCA provides suggested supply lists for creative projects, but substitutions are encouraged.
Families are welcome to use materials they already own, repurpose household items, and explore alternative approaches.
Purchasing specific brands or products is not required unless clearly stated for a particular optional activity.
Any links to recommended products or affiliate partners will be disclosed where required.
9. Parent and Guardian Responsibilities
KCCA is designed to encourage children's independence and creativity while recognizing that adult supervision remains important.
Parents and guardians are responsible for:
- Supervising children's participation at a level appropriate to their age and abilities
- Determining whether particular activities and materials are suitable for their child
- Providing assistance with potentially hazardous materials or tools
- Ensuring children use supplies safely
- Managing account access and online participation
- Reviewing and approving any information or artwork submitted through their family membership
KCCA does not provide individual childcare, direct physical supervision, or emergency assistance.
Adult account holders remain responsible for the safety and supervision of children participating in activities at home or elsewhere.
10. Art Materials and Safety
KCCA activities may involve scissors, adhesives, paints, clay, small objects, and other common art materials.
Some projects may require additional supervision or adjustments based on a child's developmental abilities.
Families should review all materials and instructions before beginning an activity.
Parents and guardians should follow product safety instructions, provide appropriate ventilation and workspace protection, and select age-appropriate materials.
Participation in any KCCA activity is voluntary.
KCCA encourages families to adapt or skip activities that are unsuitable for their circumstances.
Nothing in these Terms excludes responsibility for harm where such exclusion is prohibited by applicable law.
11. Creative Independence and Educational Expectations
KCCA believes there is value in the creative process, not simply the finished product.
Lessons encourage children to make artistic decisions, experiment with materials, solve problems, and develop their own ideas.
As a result, children's finished artwork may look very different from the examples shown during instruction.
There is no single correct artistic outcome at KCCA.
KCCA does not guarantee specific artistic abilities, educational outcomes, improvements in confidence, or individual developmental results.
KCCA is an enrichment membership and is not intended to replace formal schooling, specialized educational services, or professional developmental support.
12. Live Sessions and Replays
KCCA intends to offer two live online creative sessions per month through its In the Studio with Kristin program.
Live session dates and times will be communicated to members in advance.
Scheduling may occasionally change due to illness, technical difficulties, holidays, or other unforeseen circumstances.
KCCA will make reasonable efforts to notify members of changes and provide alternative arrangements when appropriate.
Children must participate under the supervision of their parent or legal guardian.
KCCA will provide additional information regarding the use of cameras, microphones, recordings, and session replays before those features are offered.
Any collection, recording, or disclosure of children's personal information will be subject to applicable privacy laws and required parental consent.
Members may not independently record, reproduce, or publicly distribute live sessions without written permission from KCCA.
13. Student Artwork and the Spotlight Gallery
Children retain ownership of the original artwork they create through KCCA.
Families may voluntarily submit artwork for consideration in the Student Spotlight Gallery or other KCCA community features.
Submitting artwork does not automatically grant KCCA permission to use a child's name, photograph, voice, or likeness for public promotional purposes.
Where required, KCCA will obtain appropriate parental consent before collecting or displaying identifiable children's information.
Any permission to display submitted artwork will be limited to the uses disclosed when consent is requested.
Families may request removal of submitted artwork or identifying information by contacting KCCA, subject to applicable law and technical limitations.
KCCA reserves the right to decline or remove submissions that are inappropriate, infringe others' rights, or do not meet community guidelines.
14. Intellectual Property and Use of KCCA Materials
All original KCCA instructional videos, lesson plans, teaching materials, demonstrations, graphics, written resources, branding, and other original educational content are owned by Kristin Cafferty Creativity Academy or used with appropriate permission.
These materials are protected by applicable copyright and intellectual property laws.
An active membership grants the registered household a limited, personal, nonexclusive, nontransferable license to access and use membership content for private educational and creative enrichment purposes.
Members may not, without prior written permission:
- Copy, reproduce, or redistribute instructional videos or lesson materials
- Share paid membership content publicly or with other households
- Sell, repackage, or commercially exploit KCCA educational resources
- Use KCCA materials to operate paid classes, workshops, camps, or competing educational programs
- Upload KCCA videos or proprietary materials to public websites or social media platforms
- Share account credentials to provide unauthorized access
Families are welcome to share photographs of their own finished artwork and describe their creative experiences, provided they do not reproduce or distribute KCCA's protected instructional content.
Nothing in these Terms restricts uses permitted by applicable copyright law.
15. Community Conduct
KCCA strives to maintain a welcoming, inclusive, and respectful creative environment.
Families are expected to communicate respectfully and support the creative expression of others.
Harassment, bullying, discrimination, threats, inappropriate content, unauthorized solicitation, and behavior that compromises the privacy or safety of others are not permitted.
Parents and guardians are responsible for supervising their children's participation in interactive features.
KCCA may moderate submissions, restrict interactive participation, or suspend access when reasonably necessary to protect members or enforce these Terms.
Any termination of a paid membership for a conduct violation will be handled in accordance with applicable law.
16. Technology and Platform Availability
KCCA is hosted through Kajabi and may use additional third-party platforms for payments, video conferencing, email communications, and other membership features.
Members are responsible for maintaining a suitable internet connection and compatible devices.
KCCA cannot guarantee uninterrupted access to online services.
Occasional technical interruptions, maintenance, or platform outages may occur.
KCCA will make reasonable efforts to restore access and communicate significant service disruptions.
If a substantial portion of paid services becomes unavailable, KCCA will evaluate appropriate remedies in accordance with applicable law.
17. Privacy and Children's Information
KCCA respects the privacy of participating families and is committed to protecting children's personal information.
All accounts are owned and managed by adults.
Our collection, use, storage, and disclosure of personal information are described in our separate Privacy Policy.
Where applicable, KCCA will comply with the Children's Online Privacy Protection Act (COPPA), including parental notice and consent requirements.
Please review the KCCA Privacy Policy for additional information about family privacy rights, student submissions, and data protection.
18. Changes to Membership Services or Terms
KCCA may update its educational offerings, membership features, schedules, or these Terms as the program develops.
Members will receive appropriate advance notice of material changes when required by law.
Changes to the Terms will not retroactively eliminate rights already accrued.
Any change requiring additional consent will not take effect for a member until the required consent has been obtained.
Founding member pricing commitments will remain subject to Section 5.
Members who do not wish to continue under materially revised terms may cancel their membership before the changes take effect.
19. Suspension or Termination
KCCA may suspend or terminate membership access for material violations of these Terms, unauthorized sharing of protected content, fraudulent activity, serious safety concerns, or other legitimate reasons.
Where appropriate, KCCA will provide notice and an opportunity to resolve the issue.
KCCA may also discontinue the membership program, subject to applicable notice, refund, and consumer protection obligations.
If KCCA terminates an otherwise compliant member's paid access before the end of their billing period, an appropriate refund or other remedy will be provided as required by law.
20. Limitation of Liability
KCCA provides creative enrichment activities and educational content for voluntary participation.
To the extent permitted by applicable law, KCCA is not responsible for losses arising solely from a member's failure to follow appropriate safety instructions, misuse of materials, unauthorized account access caused by the member, or technical problems outside KCCA's reasonable control.
Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, violations of applicable law, or any other liability that cannot lawfully be excluded or limited.
Any further limitations on liability are subject to applicable law.
21. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without overriding any mandatory consumer protections that apply to a member in another jurisdiction.
Nothing in these Terms deprives consumers of legal rights or remedies that cannot be waived under applicable law.
