Art Activity Safety Disclaimer & Parent/Guardian Responsibility Notice
Effective Date: October 16, 2026
Website: www.joinkcca.com
1. Purpose and Scope
Kristin Cafferty Creativity Academy ("KCCA," "the Academy," "we," "us," or "our") is an online creative education membership designed primarily for children ages 6–12 and their families.
KCCA provides educational art experiences intended to encourage creative thinking, artistic exploration, problem-solving, experimentation, independence, and confidence.
Our program may include pre-recorded Studio Projects, Sketchbook Sparks, Artistic Toolbox demonstrations, Artist Connection lessons, live online creative sessions, student artwork sharing opportunities, and other educational resources.
While KCCA strives to promote safe, age-appropriate creative experiences, participation in art activities involves certain inherent risks. Parents and legal guardians are responsible for evaluating and supervising their children's participation.
This Safety Disclaimer applies to all KCCA educational content, activities, demonstrations, downloadable resources, live sessions, and related membership experiences.
2. Parent/Guardian Responsibility and Supervision
KCCA operates through adult-managed household memberships. Children do not receive independent membership accounts.
By permitting a child to participate in KCCA activities, the parent or legal guardian acknowledges responsibility for:
- Determining whether each activity is appropriate for the child's age, abilities, maturity, experience, and individual needs.
- Providing appropriate supervision throughout activities.
- Reviewing project instructions, materials, tools, and potential hazards before beginning.
- Assisting with tasks involving sharp objects, adhesives, potentially hazardous materials, or other tools requiring adult oversight.
- Maintaining a safe, appropriately prepared creative workspace.
- Ensuring children follow applicable safety instructions and manufacturer recommendations.
- Responding to accidents, injuries, allergic reactions, or other safety concerns.
KCCA is not a childcare service, babysitting service, or substitute for adult supervision.
Participation in a live online session does not transfer supervision or responsibility for a child from the parent or guardian to KCCA or its instructor.
Parents and guardians must remain reasonably available and provide direct supervision whenever the activity, tools, materials, or child's individual needs require it.
3. Art Materials, Tools, and Equipment
KCCA activities may involve a variety of common art and household materials, including but not limited to:
- Pencils, crayons, markers, colored pencils, and pastels.
- Watercolor, tempera, acrylic, and other art paints.
- Paper, cardboard, recycled materials, and collage supplies.
- Modeling clay and other sculptural materials.
- Scissors, rulers, brushes, and basic art tools.
- Glue, tape, and age-appropriate adhesives.
- Household objects and found materials used for creative exploration.
Certain tools and materials may present risks, including cuts, punctures, skin or eye irritation, allergic reactions, choking hazards, respiratory irritation, accidental ingestion, and damage to clothing or household surfaces.
Parents and guardians agree to review and follow all manufacturer safety instructions, warnings, age recommendations, and handling guidelines.
Whenever possible, families should select art materials specifically intended for children's use, with appropriate safety labeling.
Materials requiring adult-only handling, including craft knives, hot glue guns, heat-producing equipment, or other potentially hazardous tools, must be handled exclusively by a responsible adult unless a particular tool is appropriate for the child's abilities and direct adult supervision is provided.
Children should not use solvents, alcohol-based inks, spray paints, resin systems, or other materials presenting significant chemical or inhalation hazards as substitutes for recommended children's art supplies.
KCCA does not require families to use materials they consider unsafe or unsuitable.
4. Material Substitutions and Creative Independence
Creative problem-solving and experimentation are important elements of the KCCA philosophy.
Families are encouraged to use materials they already own and to make reasonable substitutions when appropriate.
However, not all materials are interchangeable or equally safe.
Parents and guardians are responsible for evaluating any substitutions, including their suitability for children and compatibility with the activity.
Creative freedom does not override safety instructions.
Families should never substitute a material that introduces additional chemical, physical, electrical, fire, or other hazards without appropriately evaluating those risks.
If a project or material does not feel appropriate for a particular child, families are encouraged to modify, skip, or discontinue that activity.
5. Allergies, Sensitivities, and Individual Needs
Children may have individual allergies, sensitivities, medical conditions, developmental differences, or other needs that affect their ability to participate safely.
Some art supplies may contain ingredients or substances capable of causing skin irritation, allergic reactions, respiratory discomfort, or other adverse effects.
Parents and guardians are responsible for reviewing product ingredients, labels, and warnings and determining whether materials are appropriate for their children.
Where necessary, families should consult a qualified healthcare professional before using materials that may present a concern.
KCCA does not provide individualized medical evaluations or guarantee that any particular art supply, activity, or environment will be appropriate for every participant.
Participation should be stopped immediately if a child experiences discomfort, injury, breathing difficulty, or another concerning reaction. Seek appropriate medical assistance when needed.
6. Safe Workspace and Activity Preparation
Before beginning a KCCA activity, parents and guardians should ensure that the workspace is reasonably safe and appropriate.
Recommended precautions include:
- Working on a stable, protected surface.
- Providing adequate lighting and ventilation.
- Keeping food and beverages separate from art supplies.
- Protecting clothing and surrounding furniture when necessary.
- Keeping potentially hazardous tools and materials out of reach when not in use.
- Avoiding activities near open flames, heat sources, or electrical hazards.
- Washing hands after using art materials and cleaning work surfaces appropriately.
- Storing supplies safely after each activity.
Families are responsible for maintaining their own workspaces and for any spills, stains, or property damage resulting from activities conducted at home.
7. Pre-Recorded Lessons and Demonstrations
KCCA provides pre-recorded instructional videos and creative demonstrations for educational purposes.
Although demonstrations are designed to provide guidance, individual circumstances, materials, skill levels, and working environments may vary.
Parents and guardians should preview lessons when appropriate and evaluate whether additional assistance, supervision, or modifications are necessary.
The availability of a demonstration does not mean that every technique or material shown is suitable for independent use by every child.
Participants are not required to complete every activity, follow every demonstrated technique, or use every suggested material.
Families should exercise their own judgment regarding safe participation.
8. Live Online Sessions
KCCA may provide live online creative sessions, including "In the Studio with Kristin," during which members can participate in artistic activities, ask questions, and interact with the instructor.
Live sessions are intended for educational engagement and creative community participation.
Parents and guardians acknowledge that:
- Live sessions are not individually supervised childcare experiences.
- The instructor cannot continuously observe or monitor every child's physical environment, materials, or actions.
- A parent or responsible adult remains responsible for supervising the child as appropriate.
- Children must follow instructions and behave respectfully toward the instructor and other participants.
- Parents are responsible for ensuring that children do not disclose personal information during live interactions.
- Technical difficulties, interruptions, or connectivity problems may occur.
KCCA may establish additional rules concerning microphones, cameras, chat features, participation, and appropriate conduct.
KCCA reserves the right to restrict or remove participation when necessary to address safety concerns, inappropriate behavior, privacy risks, or disruption, subject to its Terms of Use.
Recording and privacy: If a live session will be recorded, families will receive appropriate notice. Any collection, retention, use, or sharing of a child's image, voice, or other personal information will be handled in accordance with KCCA's Privacy Policy, applicable law, and any required parental consent.
Participation in KCCA does not, by itself, constitute consent for a child's image or voice to be used in public promotional materials.
9. Student Artwork, Sharing, and Online Privacy
KCCA may offer opportunities for families to submit children's artwork for display within the membership community, including the Student Spotlight Gallery.
Artwork sharing is optional.
Parents and guardians are responsible for reviewing submissions and ensuring they do not contain sensitive personal information, identifying details, inappropriate content, or images of individuals who have not authorized their inclusion.
Families should avoid including full names, addresses, school information, location details, or other identifying information in submissions.
KCCA may review, decline, or remove submissions that create safety, privacy, or community concerns.
Any permissions needed for the collection, display, or promotional use of children's artwork, names, images, voices, or personal information will be addressed through applicable consent procedures and KCCA's Privacy Policy.
KCCA will not treat acceptance of this Safety Disclaimer as blanket permission to publish a child's photograph, video, voice, or identifying information.
10. Educational Nature of the Program
KCCA provides educational and recreational creative experiences.
The program is designed to support artistic exploration, creative thinking, experimentation, and the development of artistic skills.
KCCA does not guarantee any particular educational, artistic, developmental, emotional, behavioral, or academic outcome.
Individual experiences and progress will vary.
KCCA content is not intended to provide medical, psychological, occupational therapy, or other licensed professional services.
Although creative activities may contribute positively to a child's enjoyment, confidence, and personal expression, they are not a substitute for individualized professional assessment, treatment, or support when needed.
11. Third-Party Products, Supplies, and Resources
KCCA may recommend art supplies, books, materials, or other resources produced or sold by third parties.
These recommendations are intended as educational and practical guidance.
KCCA does not manufacture or independently certify third-party products and cannot guarantee their safety, suitability, availability, performance, or freedom from defects.
Families are responsible for reviewing product information, age recommendations, warnings, and instructions before purchase or use.
Some recommended products may be available through affiliate links. Any applicable affiliate relationship will be disclosed in accordance with relevant requirements.
12. Acknowledgment of Inherent Risks
Participation in hands-on art activities may involve foreseeable risks, including minor injuries, irritation, accidental exposure to materials, or property damage.
Parents and guardians acknowledge that not every potential risk can be identified or eliminated.
By permitting participation, parents and guardians acknowledge their responsibility to assess activities, select appropriate materials, provide necessary supervision, and discontinue activities when safety concerns arise.
Nothing in this Disclaimer is intended to excuse KCCA from responsibilities imposed by applicable law or to waive claims or rights that cannot legally be waived.
13. Emergencies and Injuries
KCCA does not provide emergency medical assistance, first aid, or in-person supervision through its online membership.
If an injury, allergic reaction, or other emergency occurs during an activity, the parent or guardian is responsible for stopping the activity and obtaining appropriate assistance.
In a medical emergency, contact local emergency services immediately.
Families should not rely on the instructor, live-session chat, or KCCA website for emergency response.
14. Limitation of Responsibility
To the extent permitted by applicable law, KCCA is not responsible for injuries, losses, or property damage arising solely from a family's unsafe selection or use of materials, failure to follow safety instructions, lack of appropriate supervision, or unauthorized modifications to activities.
Any limitations of liability applicable to the membership are further addressed in KCCA's Terms of Use.
Nothing in this Disclaimer limits liability where such limitation is prohibited by law, including liability that cannot legally be disclaimed.
15. Changes to Safety Guidance
KCCA may revise this Safety Disclaimer to reflect changes in program activities, materials, technology, safety practices, or applicable legal requirements.
The current version will be made available through the KCCA website.
Where legally required, KCCA will provide notice or obtain additional consent before material changes take effect.
16. Parent/Guardian Acknowledgment
By agreeing to this Safety Disclaimer during membership registration or another clearly identified consent process, the parent or legal guardian confirms that they:
- Have had an opportunity to read and understand the safety information.
- Understand that KCCA is an online educational program and does not provide childcare or in-person supervision.
- Accept responsibility for evaluating the suitability of activities and materials for participating children.
- Agree to provide appropriate adult supervision and follow relevant safety instructions.
- Understand that participation in hands-on art activities involves certain inherent risks.
- Understand that optional artwork sharing, recordings, and use of children's personal information may require separate permissions.
- Agree to follow KCCA's applicable Terms of Use and participation guidelines.
